Ownership and risk of loss will transfer in accordance with applicable law and the circumstances of the shipment.

Nothing in these Terms prevents a customer from reporting:

  • A package that was not delivered;
  • Significant shipping damage;
  • An incorrect item;
  • Missing essential components;
  • Another eligible order or fulfillment issue.

Customers should inspect delivered packages promptly and follow the reporting procedures stated in our Shipping Policy and Return & Refund Policy.

Section 6 — Lighting Installation and Electrical Safety

Lighting products may require electrical wiring, ceiling mounting, wall mounting, structural support, assembly, or other specialized installation.

Unless the applicable product information expressly states otherwise, lighting products should be installed by a qualified and appropriately licensed electrician or installation professional.

Before installation, the customer and installer are responsible for confirming:

  • That the product is appropriate for the intended location;
  • That the electrical supply and voltage are compatible;
  • That the junction box and mounting surface are suitable;
  • That the ceiling or wall can safely support the fixture’s weight;
  • That all required components are present;
  • That installation complies with applicable electrical, building, and safety codes;
  • That electrical power is disconnected before installation or servicing.

Covalite is not responsible for damage or injury caused by:

  • Improper installation;
  • Incorrect wiring;
  • Incompatible voltage;
  • An unsuitable mounting surface;
  • Insufficient structural support;
  • Unauthorized modification;
  • Failure to follow product instructions;
  • Installation that violates applicable codes or professional standards.

Improper installation, wiring, alteration, or handling may affect return eligibility when it causes or contributes to the reported issue.

This section does not limit any rights relating to a product defect that existed before installation or another responsibility that cannot lawfully be excluded.

Section 7 — Intellectual Property

The Services and their contents are owned by or licensed to Covalite, Shopify, or their respective licensors.

However, purchases made through our store are transactions directly between you and Covalite.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from your purchase of or transaction with Covalite.

Termination does not eliminate payment or other obligations that arose before termination.

To the fullest extent permitted by applicable law, Covalite and its affiliates, employees, officers, directors, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the Services.

This may include, where legally permitted:

  • Lost savings;
  • Lost data;
  • Business interruption;
  • Replacement costs;
  • Similar indirect losses.

This limitation applies regardless of whether the claim is based on contract, negligence, tort, strict liability, or another legal theory and regardless of whether the possibility of the loss was known.

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;
  • Willful misconduct;
  • Gross negligence where it cannot lawfully be limited;
  • Death or personal injury caused by liability that cannot lawfully be excluded;
  • Statutory consumer rights;
  • Any other liability that applicable law prohibits us from excluding or limiting.

Where applicable law does not permit the complete exclusion of liability, our liability will be limited to the maximum extent permitted by that law.

  • Fraudulent, malicious, or unauthorized conduct carried out through your account.

Your obligations under this section will apply only to the extent the claim results from your conduct.

We will provide reasonable notice of an indemnifiable claim and may control its defense and settlement, subject to applicable law.

You agree to provide reasonable cooperation in the defense of such a claim.

Any ambiguity will be interpreted fairly and in accordance with applicable law, rather than automatically against either party.

Any attempted unauthorized assignment may be invalid.

We may assign or transfer these Terms as part of:
